we utilize creative and forward-thinking approaches for the most complex property issues
When people think about marital agreements, “prenups” most often come to mind. Prenuptial agreements are the most popular marital agreements, as those with assets attempt to keep those assets in their bloodline if a divorce takes place. But there are other marital agreements and cohabitation agreements.
For those concerned about the possibility of divorce down the road, premarital agreements are a reasonable precaution. When a person marries, often his or her separate property co-mingles with property that is considered community property. This co-mingling can create major complications in the event of a divorce.
Premarital agreements can involve:
- Rights to control property during the marriage
- Dividing retirement and employee benefits
- Homestead rights
We have the experience and wisdom of preparing premarital and post marital agreements and the unique circumstances of our clients’ individual cases.
